Based upon a recently unsealed filing in Texas in the Fintiv vs Apple case Apple has now admitted to the court that it committed fraud on the court in denying for over three years that it had never signed NDA’s with Fintiv or its affiliates in 2011 – 13. Indeed they did. The most explosive revelation is that Apple admits it hired Fintivs lead negotiator and engineer, in what appears to be clear-cut corporate espionage, a federal crime. This is a biblical proportion story of David vs. Goliath. It appears clear now that Apple Inc negotiated with the Fintiv executive in 2011, 2012, and 2013, then hired him and launched Apple Pay using the stolen technology that is the subject of this law suit. Calls to Fintiv and its attorneys for comment were not returned and calls to Apple for comment were not returned.Apple has now had to come to court, admit that it has committed this fraud upon the court, this is serious misconduct and invariably should have very serious consequences to Apple. The big question now is, will judge Albright do a criminal referral? Will Apple’s board fire Tim Cook? Cook has been in charge of leading Apple Pay since 2011 after Steve Jobs passed away. Cook has become a billionaire on stolen technology. Will the SEC bring legal action to disgorge the billions of dollars Cook has reaped off stolen technology without ever disclosing in any 8k or 10k filings that he and Apple Inc. knew they were infringing upon Finitvs technologies intellectual property patents, which they have know about for eleven years. Having signed NDA’s in 2011-13 by their own admissions, what’s Apple‘s motive for all this horrific behavior? It’s called $2.3 trillion in increased market cap since they stole Fintiv tech, business model, and key executive. It’s clear no software or tech company is safe doing business with Apple, even under NDAas they will lie about it, steal your technology, and steal your employees. Then lie to a federal judge just as they have been lying for three years to judge Albright in Texas. In my opinion this is a massive corporate scandal, making Enron look like milk and cookies. My final question now is who goes to jail and what percentage of the $2.3 trillion will the jury award Fintiv technologies? Stay tuned this is about to get ugly for Apple, and it’s seemingly corrupt culture and leadership.
